What is a Non-Compete Agreement?
A non-compete agreement (also called a restrictive covenant or covenant not to compete) is a contract that restricts a person from working for competitors or starting a competing business for a specified period after leaving a company. Non-solicitation agreements — a related but distinct document — prevent soliciting the company's clients or employees.
Non-compete enforceability is one of the most jurisdiction-dependent areas of contract law. California bans them almost entirely. Other states enforce them only if they meet specific requirements for duration, geographic scope, and consideration. Some jurisdictions require additional compensation ('garden leave') to make them binding. A non-compete that's enforceable in Texas may be void in New York.
Contract.DIY generates non-compete and non-solicitation agreements calibrated to your jurisdiction's specific rules. We apply the correct enforceability standards, duration limits, and consideration requirements — so you get an agreement that actually holds up if challenged.
