Frequently asked questions

What should a telehealth services contract include?
It should define the virtual services provided, technology requirements, patient responsibilities, licensing limits, privacy and confidentiality obligations, payment terms, cancellation rules, emergency procedures, and dispute or governing law provisions.
Is telehealth appropriate for emergency medical situations?
No. A telehealth contract should state that virtual care is not a substitute for emergency services and that patients must contact emergency services or go to the nearest emergency facility for urgent or life-threatening conditions.
Why does the provider's licensed jurisdiction matter?
Healthcare providers generally must be licensed or otherwise authorized where the patient is located at the time of the telehealth encounter. The agreement should require the patient to disclose their location and limit services to permitted jurisdictions.
Does this contract replace a HIPAA notice of privacy practices?
No. The contract can include privacy and confidentiality obligations, but covered entities should separately provide any required notice of privacy practices and comply with applicable healthcare privacy laws and regulations.
