HMRC CEST TOOL: The Check Employment Status for Tax (CEST) tool on GOV.UK can be used to determine IR35 status. HMRC will stand by the result if used correctly. 4. EMPLOYMENT STATUS CATEGORIES: UK law distinguishes between: employee (full rights), worker (some rights including NMW, holiday, anti-discrimination), and self-employed (limited statutory protections). The contract should establish genuine self-employed status. 5. IP ASSIGNMENT: Under s.11(1) CDPA 1988, the author is the first owner of copyright. Unlike employees (s.11(2)), a freelancer's work does NOT automatically vest in the commissioning party. Explicit assignment is essential. 6. VAT: Freelancers earning above the VAT registration threshold (currently £90,000) must register for VAT.
